Recommendation:

It is recommended that the Town Council adopt the Proposed Combined Millage and Proposed Operating Budget as provided by the companion Resolutions that follow.

Background:

Due to the circumstances we are currently living through, and in an effort to provide greater transparency to our residents, this year we provided a budget summary guide delivered to each home.

At the September 8, 2020 First Budget Hearing, I provided a review of the proposed Budget and Millage that was approved unanimously.

Two factors have changed since that meeting:

The possible additional revenues that may be generated as a result of the new fee(s) approved by your action, and the savings that may materialize by changing insurance carriers and offerings. I recommend that we NOT change the Budget, and accept it as presented. We will instead freeze any savings from insurance lines from being reallocated.

I strongly encourage interested parties to please read the Proposed Budget Message Pages 28 through 33 of the Proposed Operating and Capital Fiscal Year 2020-2021 budget book. The link to the 2020-2021 Annual Budget is found on the main page of the Town’s website. www.goldenbeach.us

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA, ADOPTING THE FINAL MILLAGE RATE OF THE TOWN OF GOLDEN BEACH FOR THE FISCAL YEAR COMMENCING OCTOBER 1, 2020 THROUGH SEPTEMBER 30, 2021 PURSUANT TO FLORIDA STATUTE 200.065 (TRIM BILL); PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, on August 4th, 2020, the Town transmitted to the Property Appraiser its “Proposed Millage Rate” for the fiscal year commencing October 1, 2020 and further scheduled the public hearing required by Section 200.065 of the Florida Statutes to be held on September 8, 2020 at 7:00 p.m.; and

WHEREAS, the Property Appraiser has properly noticed the public hearing scheduled for September 8, 2020 at 7:00 p.m. via Zoom Virtual Meeting; and

WHEREAS, said public hearing, as required by Section 200.065(2)(c), of Florida Statutes was held by the Town Council on September 8, 2020, commencing at 7:00 p.m., as previously noticed and the public and all interested parties having had the opportunity to address their comments to the Town Council, and the Town Council having considered the comments of the public regarding the proposed millage rate and having complied with the “TRIM” requirements of the Florida Statutes.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA AS FOLLOWS:

Section 1. That the proposed millage rate for the Town of Golden Beach for the fiscal

year commencing October 1, 2020 through September 30, 2021, be and is hereby fixed at the rate of 7.7720 mills which is $  7.7720       dollars per $1,000.00 of assessed property value within the

Town of Golden Beach.

Section 2. That the rolled-back rate is _7.4688   and the proposed millage rate is

7.7720 mills which is 4.06 % over the rolled-back rate.

Section 3. That the voted debt service millage for the fiscal year will be _.6280_ mills.

Section 4. That the final public hearing to adopt a final millage rate and budgets for the

fiscal year will be held via Zoom Virtual Meeting on Tuesday, September 22, 2020 at 7:00 p.m.

Section 5. That the Town Clerk was directed to advertise said public hearing as

required by law.

Section 6. That this resolution shall be effective immediately upon adoption.

WHEREAS, on September 8, 2020 the Town Council held a public hearing concerning the adoption of the tentative budget for the 2020/2021 fiscal year, as duly noticed; and

WHEREAS, on September 22, 2020, the Town Council held a duly noticed final public hearing on the adoption of the final budget for the 2020/2021 fiscal year via Zoom Virtual Meeting.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA AS FOLLOWS:

Section 1. That each of the above stated recitals is hereby adopted and confirmed.

Upon final adoption of the proposed millage rate, which is hereby ratified, the attached tentative budgets of the Town of Golden Beach for the fiscal year commencing October 1, 2020 are hereby approved and adopted.

Section 2. That the Final Budget as presented by the Town Manager on September 8,

2020 to the Mayor and Town Council for the 2020/2021 fiscal year commencing October 1, 2020 and ending September 30, 2021 is hereby approved and adopted.

Section 3. That the Mayor and Town Manager are authorized to take any and all

action necessary to implement this Resolution.

Section 4. That this Resolution shall be effective immediately upon adoption.

Recommendation:

It is recommended that the Town Council adopt the attached Resolution No. 2701.20 as presented.

Background:

It has been the Town’s practice to steer away from being an “Advocate Council”.

However, when Councilmember Mendal asked the Administration to consider the attached Resolution, we jumped at the opportunity to find a way to adopt the recommendations it sets forth.

This declaration will be our guiding principle as we govern; it will serve as a tool in the application of what is right!

TOWN OF GOLDEN BEACH, FLORIDA RESOLUTION NO. 2701.20

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA RECOGNIZING THE GROWING PROBLEM OF ANTISEMITISM IN AMERICA AND CALLING FOR THE ADOPTION OF THE INTERNATIONAL HOLOCAUST REMEMBRANCE ALLIANCE WORKING DEFINITION OF ANTISEMITISM AS AN IMPORTANT EDUCATIONAL TOOL TO ADDRESS IT; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Town of Golden Beach, Florida (“Town”) finds that homeownership contributes to economic security and stability; and

WHEREAS, antisemitism, including harassment on the basis of actual or perceived Jewish origin, ancestry, ethnicity, identify, affiliation, or faith, remains a persistent, pervasive, and disturbing problem in American society; and

WHEREAS, Jews continue to be a targeted minority in the United States and are consistently the most likely of all religious groups to be victimized by incidents of hate, and such incidents are increasing at an alarming rate;

WHEREAS, the deadliest attack against the American Jewish community took place on October 27, 2018 at the Tree of Life Synagogue in Pittsburgh, Pennsylvania, killing eleven worshippers and injuring several more;

WHEREAS, state officials and institutions have a responsibility to protect citizens from acts of hate and bigotry, including antisemitism, and must be given the tools to do so;

WHEREAS, valid monitoring, informed analysis and investigation, and effective policy-making all benefit from accurate and uniform definitions;

WHEREAS, the International Holocaust Remembrance Alliance (IHRA), by consensus vote of its member states, adopted a Working Definition of Antisemitism in May 2016, which has become the internationally recognized, authoritative definition for use by governments and international organizations. That definition reads in full: “Antisemitism is a certain perception of Jews, which may be expressed as hatred toward Jews. Rhetorical and physical manifestations of antisemitism are directed toward Jewish or non-Jewish individuals and/or their property, toward Jewish community institutions and religious facilities.”

“To guide IHRA in its work, the following examples may serve as illustrations:” “Manifestations might include the targeting of the state of Israel, conceived as a Jewish collectivity. However, criticism of Israel similar to that leveled against any other country cannot be regarded as antisemitic. Antisemitism frequently charges Jews with conspiring to harm humanity, and it is often used to blame Jews for “why things go wrong.” It is expressed in speech, writing, visual forms and action, and employs sinister stereotypes and negative character traits.”

“Contemporary examples of antisemitism in public life, the media, schools, the workplace, and in the religious sphere could, taking into account the overall context, include, but are not limited to:”

  • Calling for, aiding, or justifying the killing or harming of Jews in the name of a radical ideology or an extremist view of religion.

  • Making mendacious, dehumanizing, demonizing, or stereotypical allegations about Jews as such or the power of Jews as collective — such as, especially but not exclusively, the myth about a world Jewish conspiracy or of Jews controlling the media, economy, government or other societal institutions.

  • Accusing Jews as a people of being responsible for real or imagined wrongdoing committed by a single Jewish person or group, or even for acts committed by non-Jews.

  • Denying the fact, scope, mechanisms (e.g. gas chambers) or intentionality of the genocide of the Jewish people at the hands of National Socialist Germany and its supporters and accomplices during World War II (the Holocaust).

  • Accusing the Jews as a people, or Israel as a state, of inventing or exaggerating the Holocaust.

  • Accusing Jewish citizens of being more loyal to Israel, or to the alleged priorities of Jews worldwide, than to the interests of their own nations.

  • Denying the Jewish people their right to self-determination, e.g., by claiming that the existence of a State of Israel is a racist endeavor.

  • Applying double standards by requiring of it a behavior not expected or demanded of any other democratic nation.

  • Using the symbols and images associated with classic antisemitism (e.g., claims of Jews killing Jesus or blood libel) to characterize Israel or Israelis.

  • Drawing comparisons of contemporary Israeli policy to that of the Nazis.

  • Holding Jews collectively responsible for actions of the state of Israel.

“Antisemitic acts are criminal when they are so defined by law (for example, denial of the Holocaust or distribution of antisemitic materials in some countries).”

“Criminal acts are antisemitic when the targets of attacks, whether they are people or property – such as buildings, schools, places of worship and cemeteries – are selected because they are, or are perceived to be, Jewish or linked to Jews.”

“Antisemitic discrimination is the denial to Jews of opportunities or services available to others and is illegal in many countries.”

WHEREAS, the IHRA Working Definition has proven to be an essential tool used to determine contemporary manifestations of antisemitism;

WHEREAS, in the United States, the IHRA Working Definition is utilized by various government and law enforcement agencies in monitoring, training, and education, including the U.S. Department of State and the U.S. Department of Education.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA AS FOLLOWS:

Section 1. Recitals Adopted. Each of the above-stated recitals are hereby

adopted and confirmed.

Section 2. Implementation. The Town Council will ensure that the International

Holocaust Remembrance Alliance (IHRA) Working Definition of Antisemitism is available as an educational resource for the Police Department and other Town agencies responsible for addressing antisemitism and other forms of discrimination.

Section 3. Effective Date. This Resolution shall be effective immediately upon

adoption.

Resolution No. 2702.20 – Authorizing the Mayor to Award a one-time bonus to the Employees of the Town of Golden Beach

Recommendation:

It is recommended that the Town Council adopt the attached Resolution No. 2702.20 as presented.

Background:

This resolution allows for the annual bonus for our employees. As you are aware, I did away with merit increases for our employees in 2008. Since that time, we recognize the efforts of our employees by giving annual bonuses.

This year in addition to what would be the normal consideration given to our employees, we have taken into account our employees additional efforts during the Covid-19 pandemic.

As a reminder, bonuses are a one-time occurrence.

Fiscal Impact:

An amount not to exceed $93,650.00 transferred in part from the contingency fund (or Departmental Funds if needed) and applied to specific Department Funds accordingly.

TOWN OF GOLDEN BEACH, FLORIDA RESOLUTION NO. 2702.20

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA, AWARDING EMPLOYEE BONUSES; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN EFFECTIVE DATE.

WHEREAS, the Town Council of the Town of Golden Beach, Florida (the “Town”) adopted an Operating Budget for the 2019-2020 Fiscal Year; and

WHEREAS, the Town Manager has recommended awarding one-time bonus as described in the September 22, 2020 Memorandum attached to this Resolution as Exhibit “A” for all employees, including the Town Manager for their performance during the 2019- 2020 Fiscal Year; and

WHEREAS, this year due to the Covid-19 Pandemic additional Bonus consideration was given to employees; and

WHEREAS, the Town Council finds that the proposed bonuses are in the best interest of the Town.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF GOLDEN BEACH, FLORIDA, AS FOLLOWS:

Section 1. That each of the above-stated recitals is hereby adopted and

confirmed.

Section 2. The 2019-2020 Fiscal Year Operating Budget is hereby amended as

reflected on Exhibit “A” to this Resolution and the funds are appropriated for the purposes therein.

Section 3. That the Mayor is authorized to take any and all action, which is

necessary to implement this Resolution.
